By the present I do want to let you know what follows:
In the year 1998 following an accident to the face, I contacted a
clinic, the “Clinic Cecil” who belongs to your Hirslanden group, for
a plastic reconstruction of the nose and maxillo-facial. I have been
told to refer to two very experienced and accredited doctors in the
sector and precisely: Dr Rodolphe MEYER, 81 years old, specialist in
plastic surgery and Dr Willy A. JAQUES, specialist in maxillo-facial.
The doctors after visit assured me a complet reconstruction of the nose
and face at completion of three operations. At this point and with
agreement of the clinic, the two doctors were available to operate me.
Having said that, during the first operation, planned from Dr Willy A.
JAQUES, this doctor could not operate me having been injured in a ski
accident. The clinic used to give me orders to pay three days before to
start the operation and credit respectively doctors bank accounts as
well as clinic structure. The problem came up from this moment to after:
Dr Willy A. JAQUES to not renonce to money already paid to his bank
account, has been replaced by one of his friends and colleagues, Dr
Bertrand JAQUES, a doctor not accredited at the structure, without
experience to be compared with Dr Willy A. JAQUES with 30 years of
experience in maxillo-facial. Dr Bertrand JAQUES was only an
oto-rhino-laryngologist and worked at the CHUV of Lausanne. Nobody
informed me about that substitution of doctor and all was done without
my consent to let me operate of that doctor. All the contents of the
letter of 25/10/2018 is to be contested as it does not match with
reality and in addition you wrote at paragraph 4 of the letter the
following textual words: “We confirm the fact that, according to us,
we cannot directly to intervene on a procedure of an eventual
responsibility recognition on the one hand for the reason that the
operation you mentioned has been executed from an independent doctor who
established with you a direct contract relation…”….”For what is
related to private patients and patients who pay cash, the doctor is
totally independent and he issues own honorary bills or he directly
collects the amount agreed according to your case…” What you have
written is all fake, because I did not know and never had relations and
never paid directly money to Dr Bertrand. I have only executed orders of
payments specified from your clinic; payment according to orders and
information of your clinic to Dr Willy A. JAQUES by paying the amount to
his bank account number.
After four operations for the reconstruction of the
nose and face for an estetic improvement and function of the mouth, in
Exchange, I found myself completely damaged being already unable to
close the mouth (see photo). In order to better understand the cause of
these medical mistakes, I contacted some doctors specialists of the
sector; all gave me confirmation that the technique applied since the
first operation was not correct being the first operation the structural
base of following operations. At a distance of 20 years from the first
operation executed starting on 29/1/1998 and completed on 02/7/1998, you
answered to not retain yourselves responsible sustaining you have rented
the structure to doctors: “ The clinic is responsible of the operating
activity of doctors as well as health staff directly and undirectly for
what happens inside the structure”. In spite of having done all
possible attempts with italian and suisses lawyers including judicial
authorities , the situation is not yet solved. During the month of june
of last year 2017, I have personally been in Switzerland, at the clinic
Cecil – Health Direction to speak with the Director Jean-Claude
Chatelain and at the clinic of Zurich I had a debate with the lawyer
Claudia Dusold of Hirslanden group, together a friend of mine, Mr
Giuseppe Greco, and recently, on 23 /10/2018, in order to arrive to a
positive solution for the damage I had suffered inside your clinic where
you want to decline every responsibility. I trusted believing your
clinics were attentives to the safeguard and guardianship of the patient
and you had a full control to your accredited doctors like you boast
yourselves in booklets and leaflets issued by you, but it has not been
in the reality for the fact that managers belang to clinic Cecil , they
belong until now to Hirslanden group and for what had happened to me
they showed no interest and no importance. In order to demand my rights
and to avoid that similar facts will happen to other persons, I will do
a media struggle into five languages for other 20 years to inform by
newspapers, publications, internet community and as many as possible
persons to avoid that such unpleasant facts will never happen and
clinics supervise their doctors and give guardianship to patients.
With reference to the meeting we had with you in
Switzerland in the month of June of the year 2017, at your clinic,
together Mr Giuseppe Greco, regarding the operations I have been
submitted from your accredited doctors: the four operations of the
period starting from 29/1/1998 to 2/7/1998 at your clinic Cecil executed
of Dr Rodolphe Meyer, specialist in plastic and reconstructive surgery
and Dr Willy A. JAQUES, specialist in maxillo-facial. These operations
did not give any result of stabilisation or functional improvement and
reconstruction. They caused me only serious damages and lesions in all
my face. You, as Administrators of the clinic had denied to be
responsible sustaining that you rented to doctors the hospitable
structure and surgery room. In the month of June of the year 2017, I
personally went to Switzerland, city of Zurich, where at the legal
office where worked the previous lawyer, I came in possession of my
file, and crossing the data with documents comimg from swiss entities,
in 2018 clearly highlight the responsibility of your clinic Cecil. From
the documents in our possession we recently made an important discovery:
the person who operated me in the first operation was not Dr Willy A.
JAQUES as planned, but another one: Dr Bertrand JAQUES, an external
doctor who worked at university centre of CHUV as an
oto-rhino-laryngologist, a doctor not accredited to your clinic and
without experience being not a specialist in maxillo-facial. This doctor
caused me a lot of damages as it is possible to see them on myself and
also by a medical certificate written in 2018 of a high level known
specialist surgeon. I have been deceived for the fact of not having been
informed of the substitution of the doctor and cheated from the clinic
because you ordered me to pay a specialist doctor who did not operate
me. In reality I have been operated from a doctor without experience and
competence in maxillo-facial and a doctor who does not belong,
well-known and accredited at the clinic Cecil, too. For these serious
damages and lesions caused to me, I invite and warn the temporary legal
authorized representative of the clinic Cecil of 1003 Lausanne (Switzerland),
Avenue Louis Ruchonnet , 53, to compensate me for the physical, moral,
patrimonial, existant and economical damages sustained and to be
sustained for the successive surgery operations to be done. I ask you,
therefore, a reply at the earlist for a fair compensation to my favour
in an extra-judicial way. I am available to be submitted at a medical
legal inspection. In absence or fail of what is asked, I will contact
all associations or competent judicial authorities to saveguard my
rights.
